Navigating the Global Patent System: PCT vs. Paris Convention

Under Indian law, if you are a resident of India and your invention was created here, you cannot file a patent in a foreign country without first informing the Indian government. You have two options:

- Apply for **Foreign Filing Permission (FFP)**. This is usually granted in 10-14 days and allows you to file abroad even before filing in India.

When you file a PCT application through India (as the Receiving Office), you can choose who will perform your international search. While ISA/India is the most affordable, many companies choose **ISA/EP (European Patent Office)** or **ISA/US (USPTO)** for high-tech inventions. A strong search report from a prestigious authority can make it much easier to get your patent granted when you eventually enter the national phase in those countries.
5. The Patent Prosecution Highway (PPH)
To speed up the grant of global patents, many countries participate in the **PPH**. If you get a positive examination report in one country (e.g., Japan), you can request the US or Indian patent office to "Fast-Track" your application based on that report.
