Under Section 2(o) of the Indian Copyright Act, 1957, software is protected as a “literary work”. Copyright protection automatically applies to original written source code, object code, user interfaces, database schemas, and documentation.
While copyright protection is automatic upon creation, formal registration with the Copyright Registry provides solid prime facie evidence of ownership in court. However, copyright only protects the expression of the code, not the underlying ideas or functional methods.
Unlike the United States, India has strict rules regarding software patenting. Under Section 3(k) of the Patents Act, 1970, “a computer programme per se or algorithms” are non-patentable subject matter.
To secure a patent in India, the software must show a clear connection to hardware—namely, it must produce a “technical effect” or solve a technical problem in combination with physical hardware (e.g., software controlling an industrial robot or processing raw sensor data).
Software source code per se is protected under copyright law. It is only patentable if it works in conjunction with hardware to produce a novel, non-obvious technical effect.
Trade secrets protect proprietary algorithms, database schemas, and backend methods that are kept strictly confidential through access controls and Non-Disclosure Agreements (NDAs).
A EULA is a binding contract that dictates how users can interact with your software, explicitly prohibiting reverse-engineering, copying, or redistribution.
